NGT doesn't have power to take cognisance of matter on its own: Govt to SC

The Centre Thursday told the Supreme Court that the National Green Tribunal (NGT) does not have the power to take cognisance of a matter on its own as it is not there in the statute. The Ministry of Environment, Forest and Climate Change (MoEF&CC) told a bench headed by Justice A M Khanwilkar, which is examining the issue of whether the NGT has the power to take suo motu cognisance of a matter, that procedural aspects cannot tie up the powers and jurisdiction of the peculiar tribunal which has been constituted to deal with environmental matters. It is our respectful submission that the suo motu power is not there. However, to stretch it to the extent of saying that any letter, any application etc also can't be entertained will be stretching it too far, Additional Solicitor General (ASG) Aishwarya Bhati, appearing for the ministry, told the apex court. The Chief Justice of India (CJI) N V Ramana administered the Oath of Office to the nine Supreme Court Judges on Tuesday.The nine Judge Designates are Justice Abhay Shreeniwas Oka, Justice Vikram Nath, Justice Jitendra Kumar Maheshwari, Justice Hima Kohli, Justice BV Nagarathna, Justice Chudalayil Thevan Ravikumar, Justice MM Sundresh, Justice Bela Madhurya Trivedi, and Justice Pamidighantam Sri Narasimha.This is for the first time in the history of the Supreme Court of India when nine judges had taken the Oath of Office in one go.In another first, the venue of the ceremony is shifted to the auditorium.
